            The following act of the Andhra prradesh leagislative assembly received the asssent of the Gvoernor on the 19th August, 1997 and the said assent is hereby first. Published on the 21at August, 1997 in the Andhrra pradesh Gazette for general information.

ACT NO. 26 OF 1997

AN ACT TO PROHIBIT RAGGING IN EDUCATIONAL INSTITUTIONS IN THE STATE OF ANDHRAPRADESH.

            Be it enacted by the legislative Assembly of the State of Andhra Pradesh in the Forty-eighth year of the Republic of india, as follows:-

1.      (1) This Act may be called the Andhra pradesh prohibition of Ragging Act, 1997.

            (2) It extends to the whole of the state of Andhra pradesh

            (3) It shall be deemed to have come into force with effect from 4th july

Definitions.            2. Inthis act, unless the context otherwise requires,

(a)    ‘act’ includes words either spoken or written or signs or sounds or gestures or visible or visible representatins;

(b)   Educatinal institution means and includes a college, or other instituion by whatever name called, carrying on the activity 0r imparting educatin there in (either exclusivelyu or among other activities ); and includes an orphanage or bnoarding home or hiostel or atutorial institution or any other premises attached thereto.

(c)    Government means the state Governement of Andhra pradesh

(d)   Notification means the notificatin published inb the Andhra pradesh Gazette and th4 Word notified shall be construed accordingly;

(e)    Ragging means doing an act which ehich causes or is likely to cause insult or annoyance of fear or apprehension or threat or intimidateion or outrage or modesty or injury ot a student

(f)     student means.  person who is admitted to an educaional instituion.

And whose name is lawfully borne on the attendance register thereof;

(g)   All words and expressions used but not defined in this Act shall have the meanings asigned to them undwer the Andhra pradesh Education Act, 1982 or Indian penal code, 1660 respectively.

3.      Ragging within or outside any educational instituion is prohibited.

4.      Whoever, with the intentionof causing ragging or with th4 knowledge that he is likely by such act to cause ragging, commits or abets ragging and thereby.

i)teases or embarrasses or humiliates a student shall b e punished with impri sonment for a term which may extend to six months or with fine which may extend to oe tnousand rupees or with both; or

i)                   assaults or uses criminal force ot or criminally intimidates, student shall be punished with improsonment ofor a term which mayu etern ot one year tr with fine which may extend to two thousand rupees or with both; or

ii)                 Wrong fully restrains, or wrong fully  confine or. Causes hurt top a a student shall be punished with imprisonment for a term which may extend to two years or with fine which may extend to five thosand rupees or with both;or

iii)               Causes grievourshurt to or kidnaps or abducts or rapes or commits unnatural offend with a student shall be punished with imprisonment for a term which may extend to five yers and with five which may extend to ten thousand rupees; or

iv)               Causes death or abets suicide shall be punished with imprisonment for life  or with imprisonment for a term which may extend to ten yers and with a fine which may extend to fifty thousand rupees.

5.      Dismissl of student,(1) A. Sudent convicted of an offencd under section 4 and punished with imprisonment for a term shall be dismissd from the edcaitonal instituion

(2) A student convicted of an offence under seiton 4 and punished with iniprisonement for a term of more than six months shall not be admittd inn nayother educainal instituion.

6.      (1) Suspension of student, without to the fore going provisions, whenever any student complains of ragging to the hed or manager of an educational institution, such head or manager shall inquire into or cause an inquiry into or cause ann inquiry to be made into the same forthwith and if the. Complain s primafcie found tru, shall suspend the student or students complained against for such period as may be deemed necessary.

            (2) The decision of the head or manager or the educational institution institution under sub section (1) shall be final.

Abetnient.            7. (1) If the head or the manager of an educaiona institution fails or neglects to take acion in the manner specified in sub-section (1) of secion 6, such person shall be deemed to have abetted the offence and shall be punished with the punishement provided for the offence.

1)      If a student commits suicide due to or in consequence of regging, the peroson who comits such ragging shall be deemed to have abtted such suicide.

Other laws not affefcted

8.The provisions of this act shall be in additon to and not derogratory of any lw for the time being in force.

Power to make rules.

1.      (1) The Government may notification, make rules or carrying out all or any opf the purposes of this act.

(2) Every rule made under this Act shall immediately after is is made,l be laid before tha legislativee assembly of the State, if it is in session and if it is not in session, in the session immdediately following for a total period of four teen days which may be comprised in one sesion or two sucessive sesions, and if, before, the expiration of the session imme diately following the Legislative asembly agrees in making any modification in the rule or in th annulmenbt of the , rule , the rule shall, from the date on ewhich the modificaion or annulment is notified, have efect only in such modified form or shall stan annulled as the case may be so, however, that any such modificaion or annulment shallbe without prejudice to the validity of any thing previously done udeer that rule.

Repeal of ordinance 12 to 1997

2.      the  Andhra pradesh prohibition of Ragging Ordinance, 1997 is here repeled.
